By accessing or using F MANKEY's services, including but not limited to the website, API, AI computing resources and related tools (collectively the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services. We reserve the right to modify these Terms at any time, and the modified Terms take effect when posted on the website.

2. Description of Service

F MANKEY provides enterprise AI computing infrastructure services, including but not limited to GPU computing instances, storage solutions, network connectivity and related software tools. We are committed to providing high-quality, reliable AI computing resources, but we do not guarantee uninterrupted service availability.

3. Account Registration

To use certain services you must register an account. You agree to:

providing accurate, complete and up-to-date registration information
maintaining and promptly updating your account information
being responsible for maintaining the confidentiality of your account and password
being responsible for all activity under your account
complying with all applicable laws and regulations

We have the right to suspend or terminate accounts that violate these requirements.

4. Billing and Payment

Use of our services requires payment. We offer several billing options, including pay-as-you-go, reserved instances and pre-purchase plans. You authorize us to charge the payment method you designate according to the billing option you select. All fees are exclusive of tax, and you are responsible for paying applicable taxes. Unpaid fees will incur late charges.

5. Usage Restrictions

You must not:

using the service for any unlawful purpose or in violation of any local, state, federal or international law
engaging in any operation that may damage, disable, overload or impair the service
attempting to gain unauthorized access to any part or feature of the service
using the service to spread malware or conduct cyberattacks
using the service to mine cryptocurrency (unless expressly authorized)
interfering with or circumventing our security measures
reselling or redistributing our service (unless expressly authorized)

6. Data and Privacy

You retain ownership of the data you store on our services. We will not access, use or disclose your data unless:

to provide and maintain the service
required by law or a court order
to protect our rights or property

7. Service Availability

To the maximum extent permitted by law, F MANKEY and its affiliates shall in no event be liable for any special, incidental, indirect or consequential damages arising from the use of or inability to use our services, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount of fees you paid to us in the past twelve months.

11. Indemnification

You agree to indemnify and hold harmless F MANKEY and its directors, officers, employees and agents from any claims, losses, damages, actions, costs and expenses (including reasonable attorneys' fees) arising from your use of our services, your breach of these Terms, or your infringement of any third-party rights.

12. Termination

You may terminate these Terms at any time by closing your account. We may terminate or suspend your access to the service immediately, with notice, for any reason. After termination you will lose access to the service and we may delete your account data.

13. General Provisions

These Terms are governed by the laws of the People's Republic of China, without regard to its conflict-of-law provisions. Any dispute shall be resolved in a court of competent jurisdiction in the People's Republic of China. If any part of these Terms is held invalid or unenforceable, the remaining parts shall remain in full force. These Terms constitute the entire agreement between the parties regarding the service.
